BATTLE AGAINST ICC INDICTMENTS RAGES ON (Shurat HaDin – Israel Law Center)

The battle against the International Criminal Court (ICC) and its politically motivated war crime indictments of Israeli leaders rages on. While the U.S. Congress has passed legislation imposing severe economic sanctions on those in The Hague responsible for this anti-Israel overreach, the bill was temporarily stalled in the Senate yesterday. This delay, however, is merely a setback, not a defeat.

The proposed sanctions would cripple the ICC’s ability to access the international banking system, freezing the personal accounts of its officials and targeting U.S. tech firms, such as Microsoft, that provide essential services to the court. While the Senate has yet to finalize its version of the bill, bipartisan support suggests it will pass in the coming weeks. However, key American allies, including the European Union states and Canada—all ICC members—oppose these measures and continue to back the court’s efforts.

Yet, in their arrogance, the ICC prosecutors and judges remain undeterred. Refusing to reconsider their decision, they have taken preemptive steps, such as paying staff salaries three months in advance, to circumvent the anticipated U.S. sanctions.

Last spring, ICC Chief Prosecutor Karim Khan issued arrest warrants for Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant, alleging that Israel weaponized starvation in Gaza following Hamas’s brutal October 7 terrorist massacre. In doing so, the ICC attempts to equate Hamas—a designated terrorist organization by the U.S., EU, and others—with Israel’s legitimate right to defend its citizens from murderous invaders and rapists.

When the U.S. sanctions are ultimately enacted, the ICC and its European enablers will face a moment of reckoning: either abandon these baseless indictments or risk economic collapse, which could spell the court’s demise.
